Terms of Use

These Terms of Use govern your access to and use of the SQLByte website (the "Platform") and any content, public platforms, or services offered on or through the Platform, including any associated mobile application(s) (the "Application").

These Terms of Use apply to all end users of the Platform (referred to as "Learners," "You," or "Your"). This Agreement, which includes these Terms of Use, our Privacy Policy, and any other terms and conditions published on the Platform or communicated to you from time to time (collectively referred to as the "Agreement"), outlines the relationship and responsibilities between You and Bytefusion Techsoft, the creator of this Platform, in using the services offered.

By accessing or using the Platform, You agree to be bound by the terms of this Agreement, as well as all applicable laws and regulations. It is important that you carefully read this Agreement before using the Platform, as it defines your rights and obligations.

When we refer to "Creator," "we," "us," or "our," we are referring to Bytefusion Techsoft, the creator and operator of this Platform and its content, materials, and services.

By using or visiting the Platform and its services, You expressly consent to the terms of this Agreement, including any updates or modifications made from time to time.

If you disagree with any part of this Agreement or do not wish to be bound by its terms, please refrain from using the Platform in any manner.

Access and Registration

To use the Platform, you must be at least 18 years old. If you are between the ages of 13 and 18, you must have the consent of a parent or legal guardian to access and use the Platform. By using the Platform, you confirm that you have obtained the necessary permissions from your parent or guardian. If you are under the age of 13 (or 16, depending on your country of residence), you are not permitted to use the Platform or register for any services or content offered.

To access any content (as defined below) on the Platform, you will need to register by providing your name and email address. Please refer to our Privacy Policy for details on how we handle your information. Depending on the content, you may also be required to make a payment. By registering for any content on the Platform, you confirm that the information you provide is accurate and complete, that you meet the eligibility criteria for using the Platform and its content, and you agree to notify us of any changes to your information by contacting us as provided in the ‘Contact Us’ section.

For the purposes of this Agreement, "Content" refers to any course or session (whether live or pre-recorded) offered on the Platform, including any supplementary reference materials and text files.

When you register or enroll for content, you may also gain access to discussion platforms, where you can share your thoughts and engage with others on the subject matter of the content. Participation in these Public platforms is entirely optional, and by enrolling in the content, you are not required to participate.

We reserve the right to refuse access to the Platform or remove any content you post in the Public platforms if we believe you have violated any terms of this Agreement, without prior notice.

To access the Platform and view its content, you must use a "Supported/Compatible Device," which may include a personal computer, mobile phone, portable media player, or other electronic devices that meet the necessary system and compatibility requirements. Supported/Compatible Devices may change over time, depending on the software and systems provided by the device manufacturer or third parties. Please ensure that your device is compatible with the systems used by the Platform to access the content.

License to Use

You are granted a limited, non-exclusive, and non-transferable license to access and view the Content on the Platform solely for your personal, non-commercial use.

This license does not grant you the right to assign, sublicense, or transfer the license granted under this Agreement to anyone else. You are also prohibited from:

For the purposes of this Agreement, “Creator Content” includes any audio files, video files, audio-visual content, images, text materials (including .doc, .docx, and .pdf files), and other content uploaded or published by the Creator for access on the Platform, including any content posted by the Creator in the Public platforms.

This license will automatically terminate if you violate any of the above restrictions. We also reserve the right to terminate this license at any time. Upon termination of this license, or your discontinuation of viewing any material on the Platform (including Content and Creator Content), you must destroy any downloaded materials in your possession, whether in electronic or printed form.

Code of Conduct

By using the Platform, you agree to adhere to the following guidelines:

Legitimate Usage

You agree to use the Platform solely for lawful purposes. You will not engage in any activities that violate any applicable local, state, national, or international laws, including laws related to data and software export. You also agree not to disrupt, damage, or impair the Platform or access to it, nor promote or encourage illegal activities such as hacking, cracking, distribution of counterfeit software, compromising accounts, or spreading cheats or hacks related to the Platform.

No Harmful or Dangerous Content

Any content that promotes or incites violence, causes harm (physical or emotional), endangers individual safety, or is otherwise objectionable is prohibited. The Platform is intended for uses specified in this Agreement only.

No Hateful or Defamatory Content:

While we encourage the exchange of ideas and opinions as part of the learning process, we do not tolerate hate speech or defamatory statements. This includes content that incites hatred against individuals or groups based on race, ethnicity, nationality, religion, disability, gender, age, sexual orientation, or gender identity. Any form of libel, slander, threats, violence, or predatory behavior is prohibited.

Violent and Graphic Content:

Content that aims to shock, disturb, or sensationalize is not permitted. We do not allow any content that promotes terrorist acts, violence, or incites harm to individuals.

Harassment and Bullying:

Harassment or bullying in any form, including abusive messages, revealing personal or sensitive information to humiliate others, sexual harassment, or sexual bullying, will not be tolerated. The Platform is designed to foster a safe learning environment.

Spam:

Posting irrelevant, unwanted, or repetitive content, comments, or messages to spam the Platform or drive traffic to third-party websites is prohibited. This includes posting links to harmful external sites, such as those with malware.

Scams:

Any content designed to deceive others for financial gain, including extortion or blackmail, is strictly forbidden. We do not tolerate such fraudulent activities.

Privacy Violation

Please refer to our Privacy Policy to understand how we protect your privacy and respect the privacy of other users.

Impersonation:

Impersonating someone else, including learners or organizations, is prohibited. This includes using names, images, documents, certificates, or logos that do not belong to you or are not authorized to be used for identification.

Unauthorized Access or Disabling of Platform:

You agree not to:

  1. Use the Platform in a way that disables, overburdens, or damages its functioning.
  2. Use manual processes to monitor or copy material from the Platform for unauthorized purposes.
  3. Use software, devices, or routines that interfere with the Platform’s proper functioning.
  4. Launch denial-of-service attacks.
  5. Attempt unauthorized access to the Platform, its server, or associated databases.
  6. Introduce viruses, malware, or other harmful content that could damage the Platform or its users.

Consequences of Violations:

If we detect a violation of these terms, we reserve the right to refuse access to the Platform, terminate accounts, or remove violating content at our discretion and without prior notice.

Intellectual Property

We retain all rights to the information and materials provided to you through or on behalf of us, including but not limited to Content and Creator Content in any form or medium. This includes the Platform, trademarks, logos, wordmarks, illustrations, images, designs, concepts, layout, flow, look and feel of the Platform, graphics, audio and video files, software owned or licensed to us, digital document instructions, and all other data or materials made available to you ("Creator’s Intellectual Property").

You acknowledge and agree that you do not acquire any ownership rights to Creator’s Intellectual Property through your use of the Platform or any part of it. The Creator’s Intellectual Property is protected by intellectual property laws, including copyright, trademark, patent, trade secret, and other applicable laws. Any unauthorized use, reproduction, modification, distribution, transmission, display, or performance of the Creator’s Intellectual Property or any of its components is strictly prohibited.

Feedback

If you submit any suggestions, ideas, comments, or questions regarding the Platform or its Content ("Feedback"), you grant us a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, and display such Feedback in any form, on any medium, or by any method. You agree that you will not have any intellectual property rights in the Feedback, nor will you have any claim to ownership of the Content or Platform as a result of our incorporation of the Feedback into the Platform.

Payments and Refunds

To register for any Content, you may be required to pay a fee ("Content Fee"). Please refer to the Platform for current pricing details. Payments are processed through third-party payment processors, and you should review their terms and policies regarding payments and applicable taxes. Once you purchase access to Content on the Platform, it cannot be cancelled, and no refunds will be provided unless otherwise specified in our Refund Policy.

We do not capture or store any sensitive personal information during payment transactions. Payments are processed through third-party service providers, and we recommend reviewing their terms and conditions for a clearer understanding of how your payment information is handled.

Disclaimer

The Platform is provided to you "AS IS" and "AS AVAILABLE" without any warranty of any kind, either express or implied. To the maximum extent permitted by applicable law, the Creator, on behalf of itself, its affiliates, licensors, and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Platform. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any warranties that may arise out of course of dealing, course of performance, usage, or trade practice.

Without limiting the foregoing, the Creator makes no representation or warranty that the Platform or any services or products offered will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards, or be error-free. The Creator does not guarantee that any errors or defects in the Platform will be corrected.

Specifically, the Creator makes no representation or warranty with respect to:

  1. The operation or availability of the Platform, or the information, content, and materials included therein.
  2. The uninterrupted or error-free performance of the Platform.
  3. The accuracy, reliability, or currency of any information or content provided through the Platform.
  4. The absence of viruses, scripts, Trojan horses, worms, malware, time bombs, or other harmful components in the Platform, its servers, content, or emails sent from or on behalf of the Creator.

Some jurisdictions may not allow the exclusion of certain types of warranties or limitations on statutory rights of consumers. In such cases, some or all of the exclusions and limitations outlined above may not apply to you. However, in such cases, these exclusions and limitations will be applied to the greatest extent enforceable under applicable law.

Limitation of Liability

The Creator shall not be liable for any damages, including but not limited to loss of data or profits, or any business interruptions, resulting from the use or inability to use the Content or any other materials on the Platform, even if the Creator or any authorized representative has been informed, orally or in writing, of the potential for such damages. Some jurisdictions do not allow limitations on implied warranties or liability for consequential or incidental damages, so some or all of these limitations may not apply to you.

Indemnity and Release

You agree to indemnify and hold harmless the Creator, including its officers, directors, agents, and employees, from any claim, demand, or action (including reasonable attorney’s fees) made by a third party due to or arising out of your breach of this Agreement, any document incorporated by reference, or your violation of any law, regulation, or the rights of a third party.

Links to Third-Party Websites

The Creator has not reviewed all of the websites linked to the Platform and is not responsible for the content on any such linked site. The inclusion of any link does not imply endorsement by the Creator of that site. Use of any linked website is at your own risk.

Governing Law and Jurisdiction

Any claim related to the Platform will be governed by the laws of the Creator’s home jurisdiction (as provided on the Platform), without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in the Creator’s home jurisdiction.

Miscellaneous

Alteration of Platform or Amendments to the Conditions: We reserve the right to change the Platform, policies, and this Agreement at any time. Any updates will be posted with a revision date indicated at the top. You should check the Platform regularly for any changes. The terms in effect when you use the Platform will apply, unless a change is required by law or government authority (in which case it will apply to prior orders). If any condition is deemed invalid or unenforceable, it will be severed from the Agreement, and the remaining conditions will continue in full force.

Waiver: If we do not act on your breach of this Agreement, it does not mean we waive our right to enforce our rights in any future breach situations.

Assignment: You may not assign or transfer this Agreement. Any attempt to do so will be considered null and void.

Severability: If any provision of this Agreement is found to be unenforceable by a court, that provision will be limited to the minimum extent necessary, and the rest of the Agreement will remain in effect.

Events Beyond Our Reasonable Control: We will not be held liable for delays or failure to meet obligations caused by events beyond our reasonable control. This does not affect your statutory rights.
